就労ビザ更新が不許可となった理由と再申請の注意点｜熊本県内の企業様からのご相談

熊本県内の企業様より、外国人従業員の「技術・人文知識・国際業務」ビザの更新が不許可となった件についてご相談をいただきました。

この在留資格は、企業において専門的な業務（例：経理・企画・翻訳・システム開発など）に従事する外国人が取得するものですが、更新を含め、申請の際にはいくつか重要なポイントがあります。

特に重要なのが、「職務の専門性」および「学歴や実務経験との業務との関連性」です。

今回のケースでは、申請書類の記載内容や業務説明において、その「専門性」や「関連性」が十分に伝わっていなかったことが、不許可の主な要因であると考えられます。

たとえ適正に勤務していたとしても、大学等での専攻やこれまでの実務経験と無関係な業務に従事していると判断されると、不許可となる可能性があります。

ご相談を受けて、弊所からは以下のようなアドバイスをいたしました。

・不許可理由通知書の内容を正確に把握すること

・必要に応じて職務内容や就労実態を補強する資料を用意し、再申請を検討すること

・申請書類の記載方法を見直し、専門性の裏付けを明確にすること

正当に在留活動をしていたとしても、書類の書き方ひとつで入管庁に誤解を与えてしまうことがあります。特に「更新申請」は一度在留資格の認定を受けていることから軽視されがちですが、初回申請と同様に慎重な対応が求められます。

A company in Kumamoto Prefecture consulted us regarding a case where a foreign employee's "Engineer/Specialist in Humanities/International Services" visa renewal was not approved.

This status of residence is obtained by foreigners who work in specialized jobs (e.g. accounting, planning, translation, systems development, etc.) in a company, but there are several important points to consider when applying, including renewal.

What is particularly important is the "specialization of the job" or "the relevance of the job to your educational background and practical experience."

In this case, the main reason for the denial is believed to be that the "expertise" and "relevance" of the work were not sufficiently conveyed in the application documents and job description.

Even if you are working properly, your application may be denied if it is determined that your work is unrelated to your major at university or your work experience.

After receiving a consultation from the company, our office offered the following advice:

- Accurately understand the contents of the notice of denial of permission

- Prepare documents to reinforce the job description and working conditions as necessary, and consider reapplying

(including determining whether reapplication is possible)

- Review the way in which residence status application documents are filled out, and clearly show evidence of expertise

Even if your residence activities have been legitimate, the way you write your documents can lead to misunderstandings with the Immigration Bureau. In particular, "renewal applications" tend to be overlooked because your residence status has already been approved, but they require careful handling just like initial applications.
