エンジニア社員様の在留期間更新申請を行いました。

先日、熊本県菊池郡にある台湾企業の日本法人様（TSMC関連のサプライヤー企業様）よりご依頼をいただいた外国籍エンジニア社員の方の「技術・人文知識・国際業務」ビザに関する在留期間更新申請を行いました。

最初の「在留資格認定書交付申請」とは審査のポイントが異なり、入国後の日本国内での在留活動実績が重視されます。

主なポイントとしては、下記のとおりです。

・雇用契約が現在も有効であるか

・実際の業務内容が在留資格の範囲（技術・人文知識・国際業務）に適合しているか

・給与水準や納税状況、社会保険加入等、日本国内において適切に就労、生活しているか

・認定申請時（あるいは前回更新申請時）の内容と大きな乖離がないか

更新申請の際には、申請人個人の課税証明書や納税証明書業務内容など、認定申請では求められなかった資料が必要となります。

また、企業側のご担当者様には、外国人社員の受け入れ体制やサポート体制の整備に加え、定期的な就業状況の確認や記録も重要な役割となります。

最近、弊所にもエンジニア等の技術職員の在留資格認定や更新申請において「不許可」となったケースに関するご相談が増えております。

「前回の申請で問題なかったから今回も大丈夫」と油断してしまうと、不許可処分や在留期間の短縮といったリスクに直結する可能性もありますので、十分ご注意ください。

【Visa Status Renewal Application for Foreign Engineers】

Recently, I submitted a visa status renewal application for a foreign engineer employed by the Japanese subsidiary of a Taiwanese company (a TSMC-related supplier) located in Kikuchi District, Kumamoto Prefecture.

My office has been continuously receiving consultations and requests related to residency status from multiple supplier companies following TSMC's expansion into Kumamoto. I aim to continue providing meticulous support so that foreign employees can work in Japan with peace of mind over the long term.

In addition to engineering positions, I also handle residency procedures for employees engaged in interpretation, translation, and administrative roles such as HR, general affairs, and accounting. Furthermore, I offer support for applications for "Dependent" visas for accompanying family members of employees.

It is important to note that the screening points for the initial “Certificate of Eligibility” application differ from those for renewal applications. In renewal cases, the applicant's actual track record of residency activities in Japan is emphasized.

Key points for renewal applications include:

- Whether the employment contract is still valid

- Whether the actual job duties align with the scope of the visa status (Engineer/Specialist in Humanities/International Services)

- Whether the applicant is working and living appropriately in Japan in terms of salary level, tax payments, social insurance enrollment, etc.

- Whether there are any significant discrepancies from the contents of the previous application (Certificate of Eligibility or previous renewal)

Unlike the Certificate of Eligibility application, additional documents such as the applicant’s tax certificates and proof of job duties are required for renewal.

For the company representatives, it is also essential to establish a solid support system for foreign employees, as Ill as to regularly confirm and document the employees’ work status.

Recently, my office has seen an increase in consultations regarding "denials" of visa status certification or renewal applications for engineers and other technical staff.

Please note that assuming “there was no issue last time, so this time should be fine” could lead directly to risks such as denial of the application or shortening of the permitted period of stay.
