永住許可申請のご相談をいただきました｜熊本県内で就労ビザにより約10年間在留中のお客様

現在、熊本県内において就労ビザ（就労系在留資格）をもって就労されている、カナダご出身のお客様より、永住許可申請に関するご相談をいただきました。

当該のお客様は、日本に10年近く在留されており、これまで継続して就労されている状況です。

一般的に、就労ビザから永住許可申請を行うためには、引き続き10年以上日本に在留していることが必要とされており、あわせてそのうち直近5年以上は就労系の在留資格をもって就労していることが求められます。

一方で、「高度専門職」のポイント制において所定の要件を満たす場合には、在留資格が高度専門職でなくても、永住許可申請に必要な継続居住要件が緩和されます。

具体的には、高度専門職ポイントが70ポイント以上を継続して有している場合は3年、80ポイント以上を継続して有している場合は1年の在留で、永住許可申請が可能とされています。

また、継続居住要件に関しては、3か月以上の出国、または年間で100日以上の出国がある場合には、原則として「継続して日本に住んでいる」とはみなされなくなります。

ただし、業務上の出張による出国など、やむを得ない特段の事情がある場合には、この限りではありませんので、個別の事情を踏まえた慎重な判断が必要となります。

永住許可申請においては、これらの継続居住要件のほかにも、安定した収入状況、納税義務の履行状況、素行善良要件など、さまざまな審査要件がございます。

今回のご相談においては、お客様のこれまでの在留状況や就労内容等を詳しくお伺いし、永住許可の可能性や、申請にあたって考えられるリスクについてもご説明いたしました。

なお、現在、政府においては永住許可要件の厳格化が検討されており、将来的には、最長（5年）の在留期間を有する方に限定するといった、従来の原則に戻る可能性も指摘されています。その場合、現行制度のもとで申請可能な外国人の方が、今後はより限定される方向に進むことも予想されます。

A client from Canada who is currently working in Kumamoto Prefecture on a work visa (work-related residence status) consulted us about applying for permanent residence.

The client has been residing in Japan for nearly 10 years and has been continuously employed.

Generally, in order to apply for permanent residence from a work visa, you must have resided in Japan continuously for more than 10 years, and you must have been working on a work-related residence status for at least the last 5 of those years.

On the other hand, if you meet certain requirements under the points-based system for "Highly Skilled Professionals," the continuous residence requirement for applying for permanent residence will be relaxed, even if your status of residence is not "Highly Skilled Professional."

Furthermore, with regard to the continuous residence requirement, if you leave Japan for more than three months or more than 100 days a year, you will generally no longer be considered to be "continuously residing in Japan."

However, this does not apply in cases where there are unavoidable special circumstances, such as leaving Japan for business trips, so careful consideration is required based on individual circumstances.

In addition to these continuous residence requirements, there are various other screening requirements for permanent residence applications, such as stable income, fulfillment of tax obligations, and good conduct.

During this consultation, I asked the client in detail about previous residence status and employment status, and explained the possibility of obtaining permanent residence and the possible risks involved in applying.

The government is currently considering tightening the requirements for permanent residence permits, and it has been pointed out that in the future, it may return to the previous principle of limiting applicants to those with the longest period of stay (5 years). In that case, it is expected that the number of foreigners who can apply under the current system will become more limited in the future.

At my office, I conduct thorough interviews with clients who are considering applying for permanent residence, and then carefully check each application requirement.
