経営・管理ビザの更新申請が許可されました│新基準での更新対応│熊本市

先日、弊所クライアント企業様よりご依頼いただいた、社長様の経営管理ビザの在留期間更新申請が無事に許可されました。
基準改正後の申請であったこともあり、更新が無事に許可され、弊所としましても安堵いたしました。
1.最近の審査厳格化と追加提出書類
最近では、在留資格「経営・管理」に関する審査は特にに厳格化しており、経営者が適正に経営・管理業務を行っていることや、会社の事業内容・財務状況・各種法令遵守状況について、客観的資料に基づき具体的に説明することが強く求められています。
2025年7月17日以降の更新申請においては、「直近の在留期間における事業の経営又は管理に関する活動内容を具体的に説明する文書（任意様式）」が新たに提出書類として追加されています。
そして、令和7年10月16日には、在留資格「経営・管理」に係る上陸基準省令等の改正が施行されており、今回は改正後の新基準に基づく在留期間更新申請となりました。
なお、既に在留資格「経営・管理」で在留中の方が、施行日から3年を経過する日（令和10年10月16日）までの間に在留期間更新許可申請を行う場合には、改正後の基準に適合していない場合であっても、経営状況や将来的に改正後の基準に適合する見込み等を踏まえ、総合的に許否判断が行われるとされています。
一方で、施行日から3年を経過した後に行われる在留期間更新許可申請については、改正後の基準に適合していることが必須となります。

2.改正後における主な変更点と実務上の注意点
今回の改正では、従来の要件から大きな変更がなされており、特に以下の点について審査が厳格化されています。
事業の規模・安定性
資本金要件も500万円から3000万円に引き上げられたため、上記3年以内に資本金要件も満たす必要があります。更新申請時点で満たしていない場合、この3年の期間内に資本金要件を満たす見込みがあるかどうかも重要です。その見込みを判断するために入管が求める資料を提出することも求められる場合もあります。
経営者としての活動状況
日本語による会社の業務遂行能力（経営者または職員の日本語能力）
経営者または社員の中に、日本語で十分なコミュニケーションを行うことができる者がいることを証明する資料（住民票や日本語能力証明書）の提出も、改正後の新たな要件の一つとなっています。
個人の適切な納税・社会保険料納付だけでなく、会社自体の適切な労働保険・社会保険けの加入・納付および納税状況
経営者個人に関する書類に加えて、会社としての納税義務の履行状況、社会保険および
労働保険への加入・保険料納付状況を証明するため、各関係機関から発行される証明書
等の提出が新たに求められ、更新申請時に提出すべき書類も大幅に増加しました。

【Application for renewal of my business manager visa has been approved. │Renewal under the new criteria│Kumamoto City】
Recently, the application for extension of the period of stay of the company president's business manager visa, which was requested by one of our client companies, was successfully approved.
As this application was submitted after the revision of the visa criteria, we were relieved that the extension was approved.
1. Recent Stricter Review Processes and Additional Required Documents
Recently, the review process for the "Business Manager" residence status has become particularly strict. Applicants are strongly required to provide concrete, objective documentation demonstrating that they are properly conducting business operations, as well as explaining the company's business activities, financial situation, and compliance with various laws and regulations.
For renewal applications submitted on or after July 17, 2025, a new document, "A document (any format) specifically explaining the business management or administration activities during the most recent period of stay," has been added as a required document.
Furthermore, on October 16, 2025, amendments to the Ministerial Ordinance on Landing Criteria for the "Business Manager" status of residence came into effect, and this time, the application for extension of the period of stay was based on the new criteria after the amendment.
For those already residing in Japan under the "Business Manager" status of residence, if an application for extension of period of stay is submitted within three years of the enforcement date (October 16, 2028), even if the applicant does not currently meet the revised criteria, a comprehensive decision will be made based on factors such as the business situation and the likelihood of future compliance with the revised criteria.
On the other hand, for applications for extension of period of stay submitted after three years from the enforcement date, compliance with the revised criteria is mandatory.

2. Main Changes and Practical Points to Note After the Amendment
This amendment involves significant changes from the previous requirements, and the review process has been made stricter, particularly regarding the following points:
* Business Scale and Stability
The capital requirement has also been raised from 5 million yen to 30 million yen. Therefore, for renewal applications, it is necessary to meet the capital requirement within the three-year period mentioned above. If the capital requirement is not met at the time of renewal application, it is important to demonstrate whether there is a prospect of meeting the capital requirement within this three-year period. You may be required to submit documents requested by the Immigration Bureau to determine this prospect.
* Activities as a business owner
* Company's ability to conduct business in Japanese (Japanese language proficiency of the owner or employee)
Submission of documents (such as a resident registration certificate or Japanese language proficiency certificate) proving that there is an owner or employee who can communicate adequately in Japanese is one of the new requirements under the revised regulations.
* Appropriate tax and social insurance payments by individuals, as well as the company's own appropriate enrollment in and payment of labor insurance and social insurance, and tax payment status
In addition to documents concerning the individual owner, the submission of certificates issued by relevant institutions to prove the company's fulfillment of tax obligations and its enrollment in and payment of social insurance and labor insurance premiums has been newly required, significantly increasing the number of documents that must be submitted when applying for renewal.
